Terms of Use

These terms govern your use of the Lowerland website. They cover what you may and may not do here, who owns the words and photographs on it, and the limits of what we can be held responsible for. They are separate from our Terms of Purchase, which govern orders you place. By using this website you agree to these terms; if you do not agree with them, please do not use the site.

This website is operated by Lowerland (Pty) Ltd, of Lowerland Farm, R386, Prieska, Northern Cape, South Africa. Our full supplier details are published in our Legal Hub.

2. Who may use this website

You may browse this website at any age, but you must be 18 years or older, and legally able to enter into a contract, to place an order. Wine may only be viewed for purchase, ordered and received by persons aged 18 or older, and we verify age before wine can be added to a basket. See our Alcohol Policy.

We sell and deliver only within South Africa. If you use this website from elsewhere, you do so on your own initiative and are responsible for compliance with your local law.

3. Your account

You may create an account to place orders and track them. If you do:

• Give us accurate and complete information, and keep it up to date. A wrong delivery address on perishable goods usually means the goods are lost.
• Keep your password confidential. You are responsible for activity that takes place under your account.
• Tell us promptly at orders@lowerland.co.za if you believe someone else has gained access to your account.

We may suspend or close an account that is being used in breach of these terms, or where we reasonably suspect fraud. You may close your account at any time by contacting us.

4. Acceptable use

You may use this website to read about the farm, to browse and to buy. You may not:

• Use it for any unlawful purpose, or in a way that breaches South African law.
• Introduce viruses, malware or any other harmful code, or attempt to gain unauthorised access to the site, its server, or any account that is not yours.
• Interfere with the operation of the site, including by placing automated or artificial load on it.
• Circumvent, or attempt to circumvent, our age verification for wine.
• Place orders using false information, another person’s payment details, or an identity that is not yours.
• Harvest email addresses or personal information of other users from the site.
• Resell our Goods commercially without our written agreement. Buying for your household, your business kitchen or as a gift is of course welcome.

Unauthorised access to, or interference with, this website is an offence under the Cybercrimes Act, 19 of 2020, and we will report it.

5. Our content

The text, photographs, recipes, farm writing, logos and design on this website belong to Lowerland (Pty) Ltd or are used by us under licence, and are protected by the Copyright Act, 98 of 1978, and by trade-mark law. The name Lowerland and our logo are our marks.

You may read, print and share our pages for your own personal, non-commercial use, and you may quote short extracts with attribution and a link back to the page. You may not reproduce our photographs or substantial parts of our writing commercially, or present our content as your own, without our written permission.

We are glad for search engines, answer engines and other services to index and cite this website, provided the source is attributed. This permission does not extend to reproducing our photographs or wholesale copying of our pages.

6. Reviews and anything you post

Where the site allows you to submit a review or other content, you must have bought or used the product you are writing about, and what you write must be your own honest opinion. Do not post anything unlawful, defamatory, hateful, or that infringes someone else’s rights or privacy.

By submitting content you give us a non-exclusive, royalty-free right to display it on this website and in related material, and you confirm you have the right to give us that permission. We may decline to publish, edit for length, or remove content that breaches this clause. We do not edit reviews to change their meaning or to remove criticism.

7. Accuracy of information on this site

We take care that product descriptions, prices, availability and farm information are accurate and current, but we do not warrant that everything on the site is free of error at every moment. Prices and availability may change, and stock levels for a working farm move with the season.

Where information on the website differs from the information printed on the packaging of a product, the packaging is correct. Where a listed price is obviously wrong, clause 5 of our Terms of Purchase applies.

Nothing on this website is medical, dietary or nutritional advice. If you have an allergy, an intolerance or a medical condition, consult a qualified professional and read the packaging.

8. Availability of the website

We do not guarantee that the website will be available uninterrupted or error-free. We may suspend, withdraw or restrict all or part of it for maintenance or for business reasons, and we will give notice where we reasonably can.

9. Links to other websites

This website may link to sites we do not control, such as our couriers, our payment provider or our social media pages. We provide those links for convenience. We are not responsible for the content of those sites or for how they handle your personal information, and a link is not an endorsement. You may link to our home page or to any of our public pages, provided you do so fairly and do not suggest an association or approval that does not exist.

10. Privacy, cookies and advertising

How we handle your personal information is set out in our Privacy Policy, and the cookies this site sets are listed in our Cookie Policy. Both are written to the Protection of Personal Information Act, 4 of 2013.

We want to be plain about advertising. Lowerland does not conduct behavioural remarketing or retargeting. We do not build advertising profiles of visitors, we do not follow you around the internet with adverts for our products, and we do not sell or rent your personal information to anyone. We measure how the site is used so that we can improve it, and you can switch that measurement off at any time from our Cookie Policy page. We send email only to complete your order or because you asked us to; we do not run marketing campaigns.

This is a commitment, not a description of a default setting. If it ever changes, we will update this page and our Cookie Policy before the change takes effect.

11. Our liability

This website is provided as it stands. To the extent permitted by law, we are not liable for loss arising from your use of, or inability to use, the website, or from reliance on information on it, including indirect or consequential loss and loss of profit.

This clause does not affect our obligations to you in respect of Goods you have bought, which are governed by our Terms of Purchase and by the Consumer Protection Act. Nothing in these terms excludes or limits any liability that may not lawfully be excluded or limited, including liability under section 61 of the Consumer Protection Act.

12. Changes to these terms

We may update these terms from time to time. The version published on this page at the time you use the website is the version that applies.

13. Governing law

These terms are governed by the law of the Republic of South Africa and are subject to the jurisdiction of the South African courts.
